Credit Card Terms & Conditions

'BDC PhoneClub' is operated by The Blackdog Communications

YOU CAN NOT USE THIS SERVICE UNLESS YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE.


Agreement
This is a legal agreement ('the Agreement') between you and The Blackdog Communications ltd ('the Company') and by registering to use the service of the PhoneClub you become a member of the Blackdog Communications service
('the Service') and you agree to be bound by the Terms and Conditions of this Agreement for as long as you continue to be a member. Therefore please read the Agreement carefully before registering and if you do not agree to the terms do not register for the Service. You represent, warrant, covenant and agree: That you will abide by all of the terms and conditions of this Agreement, and you will use the Service in accordance with all applicable laws and regulations. Your membership is for your own sole personal use and benefit and you shall not assign, license or transfer it to any third party. You shall not under any circumstances authorise others to use your membership. You will defend, indemnify and hold harmless the Company, its officers, directors, servants or agents and all other members against any losses, costs, liabilities and expenses (including legal fees and expenses) relating to or arising out of your use of the Service or this Agreement..

Privacy

Subject to your full compliance with the terms of this agreement: the Company will keep confidential all information supplied by you to the Company (including credit card numbers)

DISCLAIMERS

Provision of Service
The Company provides the Service on an "as is" basis and grants no warranties of any kind, expressed or implied by Statute, common usage or otherwise. In particular the Company disclaims any implied warranties of merchantability, fitness for the purpose, or non-infringement. The Company does not warrant that your use of the Service will be secure or private; that your use will be
uninterrupted, always available, error free or that it will meet your requirements or that any defects will be corrected.

Changes in Service
The Company may limit your right to use the Service by imposing limits, conditions and/or restrictions from time to time at the sole and unfettered discretion of the Company. The Company may alter, suspend or discontinue any aspect of the Service at any time including the availability of any Service feature or database or content within such feature or database. The Company may do any of the foregoing without notice or liability to you.

Termination or Suspension
The Company may terminate or suspend your membership at any time, for any reason, without explanation, effective upon notice to you. The Company expressly reserves the right to immediately suspend or terminate your access to the Service without notice upon any breach of this Agreement by you of which the Company becomes aware.

Proprietary Rights
Ownership of all copyright, intellectual property rights and other moral rights in the Service, it's websites, bulletins, communications, or any data, content, information or other material appearing in them or any of them, (collectively called 'The Work') shall vest absolutely and beneficially in the Company, whether or not identified as copyrighted. You shall not copy, publish, download, modify,
transmit, distribute, perform display or sell The Work or any part thereof.

Interpretation and Operation of Agreement
This document embodies the entire Agreement and you may not rely on any representation, promise, or any understanding not expressly set forth in this Agreement, which shall not be amended, modified or varied except by notice duly communicated to you or attached herewith by the Company. No failure or delay by the Company to exercise any right or remedy under this Agreement shall be or be deemed to be a waiver thereon. If any term of this Agreement or any part thereof shall be or be declared illegal invalid or unenforceable for any reason by a Court of competent jurisdiction, such terms or provisions shall be divisible from the balance of the Agreement and shall be deemed to be deleted.

Proper Law

The terms and conditions of this Agreement on which the Service is provided by the Company shall be governed by the Laws of Ireland.

Jurisdiction

Disputes arising from this Agreement or the use of this Service shall be subject to the non-exclusive jurisdiction of the High Court of Ireland.

PAYMENT TERMS

Telephone Chat
Where priced in Euros, Phoneclub membership for Telephone Chat is (ROI) €40.70 (UK) €35.60 and is billed on the last working day of each month.
Where priced in Great British Pounds, Phoneclub membership for Telephone Chat
is £30.55 (UK) and is billed on the last working day of each month.

 

WAP Downloads

Phoneclub membership for the WAP download subscription (ROI) €20.35 (UK) €15.30 and is billed on the last working day of each month.

Text Dating/Chat
Where priced in Euro’s, the Text Dating membership costs €40.70 per month
(if registering from Ireland) and €35.60 per month (if registering from the UK).
Where priced in Great British Pounds, the Text Dating membership costs £30.55.
Each month we will automatically debit your card, and increase your texts available. A message will be sent to the mobile phone that you registered with to inform you of this. You will also be automatically topped up with 20 text credits once your text balance is at 0. An SMS message will be sent stating this to you. Your credit card will be billed on the last working day of each month. This will be known as your "Billing Date". Thereafter, we will continue to charge your credit or debit card monthly on your Billing Date until you cancel or alter your subscription in accordance with our cancellation policy. Please note that all charges to your card will appear as BDC Phoneclub.

3G Video

PhoneClub 3G Video Chat
service costs €40.70 per month (if registering from Ireland) and €35.60 per month (if registering from the UK). Each month we will automatically debit your card and increase your video chat time available.
A message will be sent to the mobile phone that you registered with to inform you
of this. Please note that all charges to your card will appear as BDC Phoneclub.
You will also be automatically topped up with 20 credits once your balance is running low, an SMS message will be sent stating this to you. You agree that we may charge your credit or debit card the appropriate monthly membership subscription.
Your credit card will be billed on the last working day of each month. This will be known as your "Billing Date". Thereafter, we will continue to charge your credit or debit card monthly on your Billing Date until you cancel or alter your subscription in accordance with our cancellation policy.You agree to update your credit card details provided to us in a timely manner and to ensure that your credit card has sufficient credit to allow your subscription to be processed. If we are unable to successfully charge to your credit or debit card any amount properly payable by you your account will be closed.

Promotional Messages
You may receive promotional SMS messages in future. To opt out, you should contact The Blackdog Communications customer support at

(if calling from ROI) or 0333 313 7721 (if calling from the UK).

Credit Expiry

If your telephone chat account is not used for a period of 60 days the balance of the account will be brought back down to zero.

Account Cancellation

If you wish to cancel your subscription you must ensure you have COMPLETED the cancellation a minimum of two (2) working days prior to your Billing Date to avoid being charged a further month's subscription. We DO NOT provide refunds for cancellations part-way through the billing period. To cancel your subscription please visit the 'Contact Us' section or contact

We may cancel or suspend your subscription at any time. Without limiting this general right, we will cancel your subscription immediately and without notice to you if we have reasonable grounds to believe that you have breached any of these Terms and Conditions or behaved in a manner that we deem unreasonable or contrary to the spirit of these Terms and Conditions
